If Santa cannot fulfill your order completely, his elves will refund any amount paid for the unfilled portion of your order within 60 days. Santa does not warrant the product will meet a particular purpose, and can't accept any liability beyond the price of any product or service offered and paid for by customers of this site. As a customer your remedy in any matter will be limited to the amount paid for a particular product or service not delivered to you.

Santa and his elves reserve the right to make changes to the terms of this site's use and the use of our products and services from time to time, and if we do, we agree to post those changes here. It's possible that there are typographical errors or other types of errors on this site. You understand that this may happen from time to time, and that it is permissible for Santa or his elves to change the site to correct any errors, update the products or services made available, or modify the Terms of use for this site and our products from time to time.

You acknowledge that Santa and his elves are pretty busy folks, and accept that Santa provides his services, along with the information in this site without any liability or warranty of any kind, whether expressed or implied. That includes any implied warranty of fitness for a particular purpose, or merchantability. If where you live, they don't allow the exclusion of any implied warranties, this may not apply to you. Santa makes no promise to modify, change or otherwise deliver any product other than the one you will receive.

Santa asks that you be nice, and that you agree to refrain from doing anything that would put you on Santa's 'naughty list', including, but without limitation any actions which harm this web site, or deliberately harm Santa, including any action which seeks to disrupt services to the site, defame Santa or this web site or link to this web site without Santa's permission. You may freely link to the site for the purpose of making positive referrals to the positive message being provided by this site.

Any information that you send to Santa except for personally identifiable information becomes the property of Santa. This includes testimonials, photos, videos, email messages, orders, and letters. You agree that Santa can use this material for any purpose, including improving his products and services, improving this site or its marketing, and that such use is free from any obligation to you.

Santa does not condone re-gifting. You agree that any product you purchase through this site is for your exclusive use, and unless you have two children in your immediate family with the exact same name and gender, not to sell, borrow or otherwise make available the product you purchased for a particular child available to another. Santa trusts that you will be good and only do good with the products and services he provides.

If you fail to receive a functional product (video message from Santa) you agree to contact our support team via phone or email at Support@ChristmasGram.com. Your written request should include a detailed written explanation of your problem. You agree to give Santa and his elves an opportunity to fix any defective message, or issue a refund. Santa wants you happy, and his elves will respond to any customer service issues as quickly as possible. If we are unable to remedy the problem, (exclusive of problems relating to your PC or DVD player) you agree that the limit of our liability is the amount paid for Santa's message.

Santa reserves the right to refund any payments made and refuse service if he thinks that the production of any message is, at his sole discretion, inappropriate. Examples may include the use of profanity or other generally offensive requests, or custom content requested for our premium product that is not something Santa feels is keeping with the spirit of this service. (Santa will not knowingly provide any message which seeks to hurt another person's feelings, tease or defame someone, or is deemed by Santa to otherwise be in bad taste).

For legal purposes, any reference to Santa, elves, or ChristmasGram.com collectively refer to the Company, doing business as ChristmasGram.com. Neither Santa, or any member of Santa's crew accept any liability for the delivery a message or failure to deliver a message. If Santa fails to deliver a message within the stated delivery time on the order form, your remedy is limited to a refund not to exceed the amount paid.
